Cancellation Policy

1. What this policy covers. It describes what happens when an order is cancelled, terminated early, rescheduled or paused. This Policy applies together with the Client Service Terms and the Terms of Use; in case of conflict, the Invoice-Agreement and the Client Service Terms prevail, while this Policy takes precedence over the Terms of Use (order of precedence — clause 3 of the Terms of Use). Terms have the meanings defined in the Terms of Use.

All amounts are shown to you before you confirm a cancellation, termination or rescheduling — you decide with the exact calculation in front of you. The calculation is shown in the order chat and also — as they become available — in the mobile application and the account area on the Website; the list of available means may change, and the unavailability of any particular one is not a breach. Display of the calculation in the order chat is mandatory and sufficient. The time limits in this Policy are calculated by UAE time (GST, UTC+4).

2. Cancellation before equipment delivery.

The "after departure" threshold is determined by the "departed" status in the order chat — you see it at the moment it occurs, and the threshold cannot be applied to you retroactively. A cancellation is sent as a message in the order chat and is deemed made at the moment it is sent, regardless of when the dispatcher responds — the 24-hour windows are calculated by your notice, not by our reaction. We show the refund calculation; the refund is made in accordance with the Refund Policy after your confirmation.

Termination during a shift. If you end the work after a shift has started — including under a one-day order — the commenced shift is payable in full and demobilisation is payable as a service; payment for subsequent shifts, if any, is refunded under clause 4.

3. Rescheduling. Rescheduling delivery to another date is not a cancellation:

An agreed rescheduling is not treated as a cancellation, and withholdings are not applied to it a second time.

4. Early termination of a multi-day or monthly order. You may terminate the order at any time, without stating reasons, by notice in the order chat. Upon termination:

Protection of the next shift. A notice given less than 12 hours before the start of the next shift does not cancel that shift — it is payable: the equipment, the Operator and transport have already been reserved for it. Termination takes effect from the following shift.

Recalculation for long-duration rates. The shift price depends on the order duration: a shift in a one- or two-day order costs more than the same shift in a monthly order — the monthly rate includes a volume discount. If you terminate a long-duration order early, the shifts used are recalculated at the rate for the actual duration set out in the rate scale of your Invoice-Agreement, and the difference is withheld from the refund. The rate scale by duration is included in the Invoice-Agreement of a long-duration order at issuance — the terms of early exit are known to you before payment. The refund will therefore, as a rule, be less than a simple multiplication of unused shifts by the monthly rate. The exact calculation is shown before confirmation.

5. Cancellation and replacement on the side of the Company or the Supplier.

6. Order pause during prolonged impossibility. If events of a general nature affecting more than just your site — natural events, large-scale flooding, closure of a district or zone by the authorities — make work impossible for a full shift or more, the order is paused: for full shifts of the pause no one pays anyone; payment for them is refunded or credited at your option. In detail — clause 9 of the Client Service Terms.

Impossibility caused by the condition of your particular site — local water accumulation due to lack of drainage, ground not made ready or washed out, consequences of other contractors' works — is not a pause and is payable as downtime for reasons on your side (clause 9 of the Client Service Terms). The distinction is simple: if the rain stopped construction across the district — it is a pause; if after the rain only your site is not ready — it is the condition of your site.

Pause limit. If a pause lasts more than 7 consecutive calendar days, either party may terminate the order by notice in the chat: payment for unused shifts is refunded in full, and neither the next-shift protection nor the rate-scale recalculation applies — the termination is caused by an external event, not by a party's choice. Until termination, the pause rules apply.

7. Force majeure. In force majeure circumstances, services actually provided — worked shifts and completed mobilisation — are payable; the advance payment for everything not provided is refunded in full (clause 19 of the Client Service Terms).

8. How to cancel or terminate an order. Write in the order chat in WhatsApp or call the dispatch desk (+971 58 577 4115, during its working hours stated on the Website). We acknowledge receipt, show the calculation and make the refund in accordance with the Refund Policy. A cancellation is deemed made at the moment the notice is sent in the order chat — the time is recorded automatically; for a cancellation by telephone, the dispatcher records it by a message in the order chat, and that message is the moment of cancellation. Cancellations are accepted only from the authorised channels of the order (clause 7 of the Terms of Use).

No cancellation is required before an invoice is paid: an unpaid invoice simply expires, no order arises, and no withholdings are possible.

Partial cancellation. If an order includes several units of equipment or several shifts, you may cancel a part — individual units or individual future shifts. The rules of this Policy apply to each cancelled unit and shift independently; the remainder of the order continues unchanged.

No-show without cancellation. If the equipment has been delivered and work cannot begin for reasons on your side and no cancellation was sent, clause 9 of the Client Service Terms applies: mobilisation and waiting time are payable, and the shift is deemed provided. Cancelling in advance is always cheaper than not cancelling — notify us as soon as your plans change.

Abuse of cancellations. Systematic reservation of equipment followed by cancellations, blocking it for other orders, may be taken into account when accepting your subsequent orders (clause 14 of the Terms of Use). We apply this right in good faith and in exceptional cases.

9. Honesty and good faith. The Company is guided by the principles of honesty and good faith; withholdings upon cancellation are compensation of actual costs, not a penalty, and we provide their substantiation on request.

10. Language. This Policy is drawn up in English; the English version prevails. By contacting us and continuing to deal with us, you confirm a sufficient command of English or that you have obtained a translation; insufficient command of English is not a ground for challenge.

11. Versions. The version number and effective date are at the bottom of the page; the version archive with SHA-256 checksums is at gi-machinery.com/legal/versions/. The version applicable to an order is the one specified in the Invoice-Agreement.
