Delivery Policy

1. What this policy covers. It describes how equipment is delivered to your site and removed from it: service area, timing, statuses, shift start, delays and replacements. It applies together with the Client Service Terms and the Terms of Use; in case of conflict, the Invoice-Agreement and the Client Service Terms prevail, while this Policy takes precedence over the Terms of Use (order of precedence — clause 3 of the Terms of Use). Terms have the meanings given in the Terms of Use. Time limits are calculated by UAE time (GST, UTC+4).

2. Service area. The current service area is published on the Website; delivery under a specific order is confirmed by the Invoice-Agreement taking into account your site address. For sites outside the published area, individual delivery is possible — the terms and mobilisation cost are calculated in the request.

3. Who performs transportation. Mobilisation and demobilisation are performed by the Supplier or a licensed carrier engaged by it; the Company does not perform transportation and does not own vehicles (clause 22.2 of the Terms of Use). Road permits for transportation, including oversized loads, are arranged by the Supplier or the carrier; passes for your site are your responsibility (clause 8 of the Client Service Terms).

4. Timing and delivery windows. The date and the delivery window are agreed when the order is placed and fixed in the Invoice-Agreement. We operate 7 days a week; there are no weekend surcharges — the price is determined by the Invoice-Agreement regardless of the day of the week. The possibility of urgent "today/tomorrow" delivery depends on the equipment category and utilisation and is confirmed in the request before the invoice is issued — we do not promise timelines we cannot confirm with a specific Supplier.

The delivery windows we propose take into account the heavy-vehicle traffic restrictions in force in the emirate (truck ban hours on certain roads, oversized-load transport requirements): some combinations of address and time are physically unavailable for a trailer, which is why the window is agreed rather than set unilaterally.

Delivery is possible at any agreed time, including night hours, where site rules and the permits you have obtained allow it. Statuses are recorded automatically around the clock; dispatch desk support is available during its working hours stated on the Website.

A change of the delivery address after order confirmation is agreed via the order chat: mobilisation is recalculated for the new address, and a shift of the delivery window caused by the change is not a delay. A change of the spot within the same site — without recalculation.

The address is confirmed by a geolocation pin in the order chat — delivery and calculations are tied to it. An error in the address or the pin is a cause on your side (clause 9 of the Client Service Terms).

Multiple units in one order. Delivery windows, statuses and recalculations apply to each unit independently: a delay of one machine does not affect the shifts of the others (clause 2 of the Client Service Terms).

5. Statuses. The progress of delivery is visible to you in the order chat: departed → on site → ready to work → completed. The time of each status is recorded automatically and used in calculations:

6. Late delivery. If the equipment is ready to work later than the agreed window for reasons not attributable to you: for a delay of up to 30 minutes, the shift price is reduced pro rata; for a delay exceeding 30 minutes, only the time actually worked is payable, with a 10% discount. The recalculation is performed automatically and reflected in the work report (clause 21.4 of the Terms of Use). This is your exclusive remedy for late delivery; losses beyond the recalculation are not recoverable.

7. Early delivery. The equipment may arrive before the window — this does not oblige you to accept it earlier: the shift begins no earlier than the agreed time unless you have expressly confirmed an early start in the chat. Waiting for the agreed time is not payable.

8. What to prepare for delivery. In brief (the full list — clause 8 of the Client Service Terms): passage and access adequate in dimensions and weight; a responsible person on site; passes where the site requires them; a level unloading spot with load-bearing ground; underground utilities marked before earthworks; work permits and NOCs; for lifting operations — the requirements of clause 22.11 of the Terms of Use. If delivery is impossible for reasons on your side, clause 9 of the Client Service Terms applies: mobilisation and waiting are payable, and the shift is deemed provided.

9. Upon delivery: contact, unloading spot, verification, documentation.

Availability of the responsible person. During the delivery window your responsible person is reachable on the telephone number stated in the order — the carrier or the Operator may call to clarify the approach. Unavailability of the responsible person that delays the delivery is downtime for reasons on your side.

Unloading spot. The unloading spot is indicated by the responsible person within the safe part of the site accessible to transport; the safety of the spot is assessed by the Operator or the carrier, and if unsafe, the nearest safe spot is chosen. Relocation of the equipment to another spot after unloading at your request is at your expense at the Invoice-Agreement rates.

Verification. The order confirmation provides you with the equipment registration number and the Operator's details. Upon delivery, check the arrivals against these details before admission to work; in case of a mismatch — a message in the chat, and do not admit to work. You may require the original documents for the equipment and the Operator. Admission without objections is treated as confirmation of conformity (clause 22.6 of the Terms of Use).

Condition documentation. Upon delivery and upon removal, the condition of the equipment is recorded by photographs sent to the order chat. This protects both parties: disputes about damage are resolved by "before" and "after" images, not by recollections.

10. Replacement of equipment or Operator at delivery. If the Supplier has sent a different crew with proper documents, the timing rules of clause 22.6 of the Terms of Use apply: notice 3 hours or more in advance — refusal free of charge no later than 1 hour before delivery, later — mobilisation is payable; notice less than 3 hours in advance — refusal is free at any time; improper documents — mandatory refusal, free of charge always.

11. Breakdown and replacement during the works. If the equipment fails, we arrange a replacement or refund the payment for the time not worked in full (clause 21.4 of the Terms of Use).

Evacuation of failed equipment. Failed equipment is removed by the Supplier within a reasonable time and in a manner that does not interfere with your works or the replacement equipment. Until removal, the risk of its safekeeping rests with the Supplier — the rule on safekeeping of equipment between shifts (clause 13) does not apply to failed equipment awaiting evacuation; all that is required of you is not to obstruct its removal and to provide access.

12. Demobilisation. Removal is performed upon completion of the order. The default removal time is after the end of the last shift; a different time is agreed in the chat. If a time cannot be agreed, removal is performed within the following day with 2 hours' notice; your presence is not required — the condition is recorded by photographs (clause 9). Ensure the exit: access, an exit pass, cleaning of the equipment from site soil where the rules require it (clause 8 of the Client Service Terms). If removal is impossible for reasons on your side, each commenced day is payable at the full shift price (clause 9 of the Client Service Terms). If your responsible person is absent at removal, the condition of the equipment and the location is recorded by photographs with a presumption of agreement after 24 hours (clause 14 of the Client Service Terms).

13. Equipment between shifts. Under multi-day orders, equipment remaining on site is under your guard and control; its safekeeping outside working hours is your risk (clause 8 of the Client Service Terms). The Supplier may, by agreement, remove the equipment overnight — in which case the risk and transport are on its side.

14. Weather and the midday break. The rules on weather stoppages, order pause and the summer midday break — clauses 6 and 9 of the Client Service Terms. In brief: the decision on safety rests with the Operator; if the Operator stopped — you pay for the time worked; if you stopped — the shift is payable; events of a general nature lasting a full shift or more — a pause with no payments either way.

15. Honesty and good faith. The Company is guided by the principles of honesty and good faith; statuses are recorded automatically and are equally visible to both parties — calculations are based on them, not on anyone's word.

16. Language. This Policy is drawn up in English; the English version prevails. By contacting us and continuing to deal with us, you confirm a sufficient command of English or that you have obtained a translation; insufficient command of English is not a ground for challenge.

17. Versions. The version number and effective date are at the bottom of the page; the version archive with SHA-256 checksums is at gi-machinery.com/legal/versions/. The version applicable to an order is the one specified in the Invoice-Agreement.
